The Vice President of the Court of Appeal has directed under CPR Rule 52.24(5)(b) that the parties attend an oral hearing. This is to review the decision of Master Bancroft-Rimmer that Microsoft filed its 6 June application for permission to appeal against the 14 April Order of Mr Justice Picken, in time and not late. Although the Court of Appeal rejected Microsoft's application for permission to appeal, this timing point is nevertheless a very important one for lawyers. We will let you know once we have a date for the hearing.
