Robert O’Donoghue KC, counsel to Microsoft, told the CAT in a case management conference today that it does not have jurisdiction to evaluate a key issue in ValueLicensing’s abuse of dominance claim against the tech company, as it does not fall within the specialist court’s remit.

Microsoft has argued that the UK’s Competition Appeal Tribunal does not have jurisdiction to hear a key preliminary issue in a standalone abuse of dominance claim against the company because it involves “pure copyright law”.
